01About these Terms

These Terms of Service (the “Terms”) govern your access to and use of the Endurland website (the “Website”); the Endurland video game, including any demo, playtest build, update, patch, downloadable content and online feature (the “Game”); and any community space we operate (together, the “Services”).

By using the Website or by installing, accessing or playing the Game, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

03Eligibility

Endurland is intended for players aged 12 and over. To play, you also need a Steam account, which requires you to meet Valve’s eligibility rules. If you are under the age of majority in your country of residence, a parent or legal guardian must read and accept these Terms on your behalf and is responsible for your use of the Services.

04Steam, purchases and refunds

The Game is distributed through Steam, a platform operated by Valve Corporation (“Valve”). When you buy the Game, you buy it from Valve. Payments, refunds, your Steam account, Steam Cloud and achievements are governed by the Steam Subscriber Agreement and Valve’s policies, in addition to these Terms. Refund requests must be made through Steam under the Steam Refund Policy.

Release dates, release windows, prices, features and platforms announced on the Website or elsewhere are estimates and may change during development. Adding the Game to your Steam wishlist creates no obligation for you or for us.

05Your licence to play

The Game is licensed to you, not sold. As long as you comply with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and play the Game for your private, non-commercial entertainment, through your Steam account and on devices you own or control.

All rights not expressly granted to you in these Terms are reserved by Venirse Media and its licensors.

06What you must not do

Unless the law expressly allows it or we give you written permission, you must not:

  • Copy, sell, rent, lend, sublicense or distribute the Game or any part of it.
  • Reverse engineer, decompile or disassemble the Game, except to the extent that applicable law, such as the rules on interoperability in Directive 2009/24/EC, does not allow this restriction.
  • Create, use or distribute cheats, bots, automation software, hacks or any unauthorised software that modifies the Game or gives an unfair advantage in online play.
  • Deliberately exploit bugs or glitches. Please report them to us instead.
  • Disrupt or overload our servers or networks, or interfere with other players’ connections or experience.
  • Circumvent any technical protection, access control or region restriction.
  • Remove or alter any copyright, trademark or other proprietary notice.
  • Use the Game for any commercial purpose, except as allowed in section 10.

You may modify your own local copy of the Game for personal use at your own risk, provided you do not use modifications to cheat or to affect other players in online sessions without their agreement, and you do not distribute them commercially. If we publish official modding tools or guidelines, those will apply.

07Online play and conduct

Endurland supports online co-op for up to 8 players. You are responsible for everything you do in the Game and for the activity on your Steam account. When playing online, and in any community space we operate, you must not:

  • Harass, threaten, bully, intimidate or discriminate against other players, or promote hatred or violence.
  • Share content that is illegal, sexually explicit, defamatory or infringes the rights of others.
  • Impersonate Venirse Media staff, moderators or other players.
  • Spam, scam or advertise, or offer to buy or sell accounts, items or services for real money.
  • Share other people’s personal data without their permission.
  • Deliberately sabotage or grief other players’ sessions or settlements.

The player hosting a co-op session can decide who joins and can remove players from that session. We are not obliged to monitor gameplay, but if you break these rules we may take proportionate action, such as a warning, a temporary restriction of online features or the termination of your licence, as described in section 14.

08Your content

You keep ownership of the content you create and share through the Services, such as character names, settlement designs, screenshots, messages and posts (“User Content”).

You grant Venirse Media a worldwide, non-exclusive, royalty-free licence, for the full duration of the applicable intellectual property rights, to host, store, reproduce, display, adapt and distribute your User Content in order to operate, improve and promote the Game, for example by featuring a settlement you shared on our community channels. Where practicable, we will credit you.

You confirm that you have all the rights needed to share your User Content and that it does not break these Terms or the law. We may remove User Content that does.

09Playtests and feedback

We may invite players to closed alpha, beta or other playtests. Participation is by invitation only and may be subject to additional terms, including confidentiality obligations, which we will present to you when you are invited. If those terms conflict with these Terms, the playtest terms prevail for that playtest.

Playtest builds are unfinished. They may contain bugs, be unstable, lack features or have features that never reach the final release, and your progress may be reset or deleted at any time. Unless the playtest terms say otherwise, you must not share content from a confidential playtest.

If you send us ideas, suggestions or feedback, you agree that we may use them freely, without any obligation to compensate or credit you.

10Videos, streaming and fan content

We love seeing Endurland played and shared. You may stream the Game, record and publish gameplay videos and screenshots, and earn money from them through the partner, advertising and donation programmes of the platforms you use, provided that:

  • You do not suggest that your content is official or endorsed by Venirse Media.
  • You do not use the Endurland name, logos or artwork as the main brand of your channel, product or service.
  • You do not publish content from confidential playtests, unless the playtest terms allow it.
  • You do not sell access to the Game’s content itself, for example by putting full gameplay behind a paywall that replaces buying the Game.
  • Your content complies with these Terms and the law.

We may withdraw this permission for specific content that breaks these conditions or harms the Game or its community.

11Intellectual property

The Game and the Website and all their content, including software, code, artwork, characters, worlds, music, sound effects, text, the Endurland name and logos and other trademarks, are owned by or licensed to Venirse Media and are protected by intellectual property laws. Apart from the licence in section 5 and the permissions in section 10, nothing in these Terms grants you any right to them.

12Virtual items and progress

In-game items, resources, currencies, characters and progress are part of the licensed Game. They have no real-world monetary value, cannot be exchanged for money and must not be sold, traded or transferred outside the Game. To keep the Game balanced and working properly, we may adjust or reset in-game elements, especially in playtest builds. Nothing in this section limits your statutory rights in relation to content you have paid for.

13Updates and availability

We may release patches and updates to fix bugs, improve performance, add content or keep the Game secure. Some updates may be required to keep playing online. We may also change, add or remove features for technical, legal, security or balance reasons, while making reasonable efforts to preserve the core experience of the Game.

We work to keep online features available, but they may be interrupted for maintenance or for reasons beyond our control, and we do not guarantee that they will be uninterrupted or error-free. If we decide to permanently shut down online features, we will give reasonable notice in advance through the Website, Steam or the Game.

14Suspension and termination

You can stop using the Services at any time by uninstalling the Game.

We may suspend or terminate your access to online features or your licence to the Game if you seriously or repeatedly breach these Terms, if you cheat or endanger other players, or if the law requires it. Any measure will be proportionate to the breach. Unless legal or security reasons prevent it, we will tell you why, and you can contest the decision by writing to cloud@venirse.com. When your licence ends, you must stop using the Game. Measures affecting your Steam account itself are a matter for Valve.

15The Website

The Website is provided for general information about the Game. Descriptions of features, characters, system requirements and release windows reflect our current plans and may change while the Game is in development. The Website contains links to third-party sites, such as Steam and Instagram, which we do not control and for which we are not responsible.

16Your consumer rights

If you are a consumer, you benefit from the statutory rights that the consumer protection law of your country gives you, including, in Spain, the rights set out in the consolidated text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007). Nothing in these Terms limits or excludes those rights.

Subject to those rights, and because the Game is a creative work under continuous development, we cannot promise that it will be free of every error or that it will meet every personal expectation.

17Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or for any other liability that cannot be excluded or limited by law.

Subject to the paragraph above, we are not liable for:

  • Losses that were not reasonably foreseeable when you accepted these Terms.
  • Losses caused by your breach of these Terms.
  • Business losses, such as loss of profits or business opportunities, because the Game is provided for private use.
  • Loss of data or progress caused by your devices, your internet connection or third-party services such as Steam, or by resets in playtest builds.

If you use the Services other than as a consumer, our total liability to you is limited to the amount you paid for the Game.

18Changes to these Terms

We may update these Terms to reflect changes in the Services, the law or our business. We will publish the new version on this page and change the “Last updated” date. If the changes are significant, we will give you reasonable notice before they take effect through the Website, Steam or the Game. If you continue to use the Services after the changes take effect, you accept the updated Terms. If you do not agree with them, you must stop using the Services.

19Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring legal proceedings in the courts of your place of residence. If you are not a consumer, the courts of Madrid (Spain) have exclusive jurisdiction.

Before starting any formal claim, we encourage you to contact us at cloud@venirse.com so we can try to resolve the issue amicably.

20General provisions

  • Entire agreement. These Terms, the Privacy Policy and any additional terms we present to you, such as playtest terms, form the entire agreement between you and us regarding the Services.
  • Severability. If a court finds any provision invalid or unenforceable, the rest of the Terms remain in force.
  • No waiver. If we do not enforce a provision immediately, we do not waive our right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours to another company, for example as a result of a merger or acquisition, provided your rights are not reduced.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Language. These Terms are written in English. If we provide a translation and there is a conflict, the English version prevails, unless the law of your country requires otherwise.
